State's Appeal of Same Sex Marriage Ruling Starts Monday

Indiana is stealing headlines this week as ten other states rally to support the Hoosier state’s position on gay marriage. 

Alaska, Alabama, Arizona, Oklahoma, South Carolina, South Dakota, Idaho, Utah and Louisiana have filed amicus briefs in favor of Indiana’s appeal in U.S. District Court of Appeals.  Last month a lower court found Indiana’s ban on same-sex marriage unconstitutional.

Neel Lane, an attorney with Akin Gump law firm, says he doesn’t expect to see Texas make it eleven states.

“They may have to undertake some expense to join an amicus brief,” says Lane.  “The state may have some kind of policy in what type of cases it will file an amicus brief in.”

Lane is representing the two Texas couples who are challenging the same-sex marriage ban in the Lone Star State, a case that could wind up before the U.S. Supreme Court.  The defendants named in the suit include Governor Rick Perry and Attorney General and gubernatorial candidate Greg Abbott. 

Lane says the state has to file their appeal brief before the 5th U.S. Circuit Court of Appeals in New Orleans on Monday.  Mr. Lane and the defendants have until September 9th.
